Apartment at auction in Via Gran Sasso 2, Rozzano, 59 m²

Via Gran Sasso 2, Rozzano (Milano)

The appraisal report in brief

  1. Occupancy and title

The property is occupied by a tenant under a lease contract registered on 09/01/2024, expiring on 09/01/2028 with automatic renewal for another 4 years unless cancelled. The appraiser states that the contract is enforceable against the proceedings because it was registered before the seizure.

«Il canone di locazione riporta data di sottoscrizione e registrazione anteriore alla data del pignoramento, pertanto il contratto risulta opponibile alla presente procedura.»

Quote from the report (Italian), page 4 ↗
  2. Planning and land-registry discrepancies

The appraiser finds that the actual state differs from the authorised technical drawings and from the cadastral floor plan. The discrepancies concern the kitchen, the living room with the bathroom, and a storage room.

«il sottoscritto PE ha rilevato delle difformità tra lo stato di fatto e i disegni tecnici»

Quote from the report (Italian), page 7 ↗
  3. Unauthorised building works

The storage room created in the former hallway includes a small part of the adjoining property unit. The appraiser considers that the discrepancy dates back to the construction and that the final variant was never filed.

«Si osserva che il ripostiglio “ingloba” una piccola porzione dell’unità immobiliare attigua.»

Quote from the report (Italian), page 7 ↗
  4. Planning and land-registry discrepancies

The building regularisation will have to be made subject to the consent of the adjoining property (sub 26), which the appraiser could not inspect because it is not part of the proceedings. The cadastral update will also depend on the regularity of that flat.

    «dovrà essere subordinata alla condivisione e all’assenso dell’attigua proprietà»

Quote from the report (Italian), page 9 ↗
  5. Regularisation costs

The appraiser estimates the costs of building and cadastral regularisation at €4,000.00, which include technical fees, a penalty, the cadastral update and the works to create the hallway for the bathroom.

    «Sommano totale costi stimati: € 4.000,00»

Quote from the report (Italian), page 9 ↗
  6. Other

The seizure affects only the 1/2 share. The appraiser considers that the unit cannot be conveniently divided and refers subsequent decisions to the Judge.

«ritiene che l’unità immobiliare stessa, singolarmente presa, non sia comodamente divisibile.»

Quote from the report (Italian), page 13 ↗
  7. Unpaid condominium fees

As of 03/06/2025, the unpaid condominium charges amount to zero for the current year and the previous year. However, the appraiser warns that the successful bidder must check the updated amounts, because they are jointly liable with the debtor.

«il futuro aggiudicatario dovrà attivarsi ed acquisire le informazioni necessarie per conoscere gli importi aggiornati»

Quote from the report (Italian), page 5 ↗
  8. Systems (plumbing, electrical, heating)

The appraiser states that the certificates of conformity for the systems are not available. The systems were working at the time of the site inspection.

«Certificazioni di conformità degli impianti Non disponibili»

Quote from the report (Italian), page 5 ↗
  9. Other

The appraiser states that the complex has no lift connecting the floors and that the property is not accessible to persons with disabilities.

«Il complesso immobiliare non è dotato di ascensore di collegamento ai piani»

Quote from the report (Italian), page 5 ↗

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit (cauzione): €7,320 (10% of the minimum offer, as the notice requires) or €9,760 if you bid the base price
  • Registration tax (imposta di registro): €1,564 if it is your first home (prima casa) (2%, minimum €1,000) or €6,688 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if the seller is a business, VAT may apply: the notice says so. If you are buying as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much lower. Ask the sale delegate (delegato alla vendita) or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Estimated total budget starting from €73,200: around €75,764-€82,388
  • Estimate starting from the minimum offer: monthly instalment of about €251 with a mortgage at 70% (€51,240) over 25 years at 3.3%; about €24,524 of savings needed: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the tax and fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
