Apartment with cellar and garage at auction in Via Lattanzio 68, Milan, 157 m²

Via Lattanzio 68, Milano

The appraisal report in brief

  1. Occupancy and title

Single lot: at the time of the inspection, the property was occupied by the debtor and his family. No lease contracts are currently in force.

«risultava occupato dal debitore e dalla sua famiglia»

Quote from the report (Italian), page 3 ↗
  2. Planning and land-registry discrepancies

Single lot, Unit 1 (apartment): the appraiser notes the demolition of a wall section between the day area and the corridor of the night area, compared with the drawings of the building permit (concessione edilizia) of 1986. For the apartment, it indicates a regularisation application (sanatoria).

«demolizione di porzione muraria posta a separazione tra la zona giorno ed il corridoio»

Quote from the report (Italian), page 11 ↗
  3. Unauthorised building works

Single lot, Unit 2 (garage): the door that separated the garage section from the cellar section is missing, a discrepancy compared with the 1986 building permit. The appraiser indicates restoration with a new door.

«risultava non presente il serramento (cancello o portone) che separava internamente al sub. 20»

Quote from the report (Italian), page 12 ↗
  4. Regularisation costs

Single lot: the appraiser estimates the total cost of building regularisation at about €3,600.00, adding the apartment, cellar and garage.

«Costo e oneri totali stimati per la regolarizzazione edilizia: Euro 3.600,00 circa.»

Quote from the report (Italian), page 12 ↗
  5. Planning and land-registry discrepancies

Single lot, Unit 2 (garage): the appraiser indicates the need for a DOCFA filing to show the separation between garage and cellar, with an expected cost of €750.00.

«richiede la presentazione di DOCFA per migliore rappresentazione»

Quote from the report (Italian), page 13 ↗
  6. Unpaid condominium fees

Single lot: unpaid condominium charges for the last two years amount to €7,972.68. The successful bidder may be asked to pay them jointly with the expropriated party, according to the appraiser.

«Spese condominiali non pagate negli ultimi 2 anni anteriori alla data della perizia»

Quote from the report (Italian), page 9 ↗
  7. Systems (plumbing, electrical, heating)

Single lot: the appraiser found no certificates of conformity for the systems.

«Certificazioni di conformità degli impianti: non rilevate.»

Quote from the report (Italian), page 6 ↗
  8. Other

Single lot: the cellar's entrance door is walled up from the inside, so the only access to the cellar is from the garage.

    «risulta murata dall’interno»

Quote from the report (Italian), page 5 ↗
  9. Other

Single lot: the deed of transfer lists the garage as an appurtenance, but the appraiser finds no binding of pertinence.

«non è citato alcun atto di vincolo di pertinenzialità»

Quote from the report (Italian), page 7 ↗
  10. Regularisation costs

Single lot: the appraiser indicates a cost of about €5,850.00 for technical fees for the cadastral regularisation, payable by the buyer.

    «Spese tecniche di regolarizzazione catastale a carico»

From the notice: full and outright ownership of an apartment on the first floor comprising four rooms plus kitchen and services, with annexed cellar room and garage on the basement floor.

If this auction also gets no bids (asta deserta), the judge can usually reduce the base price (prezzo base) by up to a quarter: at the next attempt it could start from about €726,000, with a minimum offer (offerta minima) of €544,500. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the judge decides the reduction, and in the meantime the lot may be awarded to someone else.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Occupied by the debtor: the court-appointed custodian handles the vacating on the judge's order; allow a few months before you can move in

What you really need

  • Deposit (cauzione): €72,600 (10% of the minimum offer, as the notice requires) or €96,800 if you offer the base price (prezzo base)
  • Registration tax (imposta di registro): €14,620 if first home (prima casa) (2%, minimum €1,000) or €65,440 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is being sold, VAT may apply: the notice states this. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much lower. Ask the sale delegate (delegato alla vendita) or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €726,000: approximately €741,620-€793,940
  • Estimate starting from the minimum offer: monthly instalment of about €2,490 with a 70% mortgage (€508,200) over 25 years at 3.3%; you need about €233,420 in savings: the 30% not covered by the mortgage (the deposit paid is part of this and is deducted from the price), the registration tax and fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
