Apartment with cellar and garage at auction in Via Giovan Battista Vico 21, Paderno Dugnano (hamlet of Palazzolo Milanese), 121 m²

Via Giovan Battista Vico 21, Paderno Dugnano (Milano)

The appraisal report in brief

  1. Occupancy and title

Single lot: at the inspection the property was found occupied by one of the debtors, so it is not vacant at the time of sale.

«Alla data del sopralluogo l'immobile risulta occupato da uno dei debitori.»

Quote from the report (Italian), page 3 ↗
  2. State of repair

Single lot: the appraiser describes the maintenance condition as overall poor, with finishes dating from the time of construction and the need for clearance, extraordinary cleaning and probable renovation before ordinary use.

«Le condizioni rilevate rendono necessari preliminari interventi di sgombero e pulizia straordinaria»

Quote from the report (Italian), page 8 ↗
  3. Systems (plumbing, electrical, heating)

Single lot: according to the owner, the water system has a leak in the kitchen, so water can be used only in the bathrooms; the boiler is very old, probably open-flue and not compliant.

«è presente una perdita in cucina, per cui al momento l’erogazione dell’acqua risulta»

Quote from the report (Italian), page 9 ↗
  4. Systems (plumbing, electrical, heating)

Single lot: the appraiser indicates the electrical, gas, water and heating systems as outdated and in need of revision, upgrading and certification; it recommends checks by qualified technicians.

    «impianto vetusto da revisionare, eventualmente adeguare/ristrutturare e certificare»

Quote from the report (Italian), page 9 ↗
  5. Unpaid condominium fees

Single lot: the overdue and unpaid condominium charges at the date of the appraisal are stated as €3,600, but the appraiser specifies that the total arrears, including previous years, amount to €12,625.

«Il totale degli arretrati, incluse quindi le annualità pregresse, ammonta invece a 12.625 €.»

Quote from the report (Italian), page 4 ↗
  6. Planning and land-registry discrepancies

Single lot: the land registry floor plan does not show the French window of the living room; the appraiser estimates a cost of €600 for a DOCFA filing and defines the property as not fully compliant but regularisable.

«L'immobile risulta non pienamente conforme, ma regolarizzabile.»

Quote from the report (Italian), page 5 ↗
  7. Regularisation costs

Single lot: the appraiser quantifies at €600 the costs of regularising the cadastral irregularities.

«Eventuale pratica DOCFA per miglior rappresentazione: €.600,00»

Quote from the report (Italian), page 5 ↗
  8. Occupancy and title

Single lot: the debtor was recorded as deceased on 21/01/2025, with no acceptance or transcription of the succession, so the property remains registered to the deceased for a 6/9 share.

«allo stato non consta accettazione né trascrizione della successione»

Quote from the report (Italian), page 4 ↗
  9. Other

Single lot: the court mortgage registered on the 1/9 share and the transcribed seizure are encumbrances that the proceedings should cancel; the appraiser also indicates the 6/9 share registered to a deceased debtor.

«La formalità è riferita solamente alla quota di 1/9 dei beni.»

Quote from the report (Italian), page 3 ↗
  10. Restrictions and easements

Single lot: the appraiser reports no legal encumbrances or charges that would remain with the buyer (points 4.1.1-4.1.4 state 'None').

«4.1.1. Domande giudiziali o altre trascrizioni pregiudizievoli: Nessuna.»

Quote from the report (Italian), page 3 ↗

From the notice: Apartment in Paderno Dugnano, Via Giovan Battista Vico no. 21 (hamlet of Palazzolo Milanese), of 121 m² for the full ownership share, divided as follows: A.1 cellar, consisting of a single storage room. A.2 single garage.

If this sale also ends with no bids, the judge can normally reduce the base price (prezzo base) by up to a quarter: at the next attempt it could start from about €128,250, with a minimum offer (offerta minima) of €96,188. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the judge decides the reduction and in the meantime the lot may be awarded to someone else.

How to take part

Online offer digitally signed and sent via PEC on the Public Sales Portal. Minimum offer (offerta minima) €128,250.

Official documents

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit paid by bank transfer before the auction: the percentage is set by the notice (often 10%, sometimes 20%), so check it before paying
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: the notice sets the percentage (often 10%, sometimes 20%): check it before making the bank transfer
  • Registration tax (imposta di registro): €2,665 if first home (prima casa) (2%, minimum €1,000) or €11,642 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is sold, VAT may apply: the notice states this. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: this is often much lower. Ask the sale delegate or the notary.
  • On the value-based price (cadastral income €511.29), the tax would be about €1,281 for a first home / €5,898 for a second home, always including mortgage and cadastral taxes: ask the sale delegate.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €128,250: about €131,915-€142,392
  • Estimate starting from the minimum offer: monthly instalment of about €440 with a 70% mortgage (€89,775) over 25 years at 3.3%; you need about €42,140 in savings: the 30% not covered by the mortgage (the deposit paid is part of this and is deducted from the price), the tax and fees; estimate based on a 10% deposit
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
