  1. Occupancy and title

Lot 1: the appraiser values the lot in two ways, €89,000.00 if vacant and €76,000.00 if occupied, without indicating the current status of the lot. A person heard by the appraiser declares that he and his children have been occupying some apartments for about 19 years, and that the properties have been paid for but no notarial deed (rogito) has yet been signed.

«sia lui che i suoi figli occupava alcuni appartamenti da circa 19 anni»

Quote from the report (Italian), page 3 ↗
  2. Occupancy and title

Lot 1: the appraiser values the lot both vacant and occupied, with a price difference of €13,000.00.

    «€ 76.000,00 occupato per l’intera quota»

Lot 1: in the cellar an unauthorised bathroom has been built which does not comply with regulations, and an internal staircase has been built without a building permit.

    «Nella cantina è stato realizzato un bagno abusivo e non a norma»

Quote from the report (Italian), page 11 ↗
  5. Planning and land-registry discrepancies

Lot 1: according to the appraiser the works cannot be regularised and the premises must be restored to the authorised state, subject to different future decisions by the competent bodies.

Quote from the report (Italian), page 11 ↗
  6. Planning and land-registry discrepancies

Lot 1: the cadastral records are not compliant because they reproduce the permitted state and not the actual state of the premises. The appraiser writes that compliance will only be achieved after the premises have been restored.

«convenzione urbanistica per attuazione del piano di lottizzazione in data 15 luglio 1993 n.»

Quote from the report (Italian), page 4 ↗
  9. Unpaid condominium fees

The appraiser writes that the building complex is managed independently by the occupants. It does not indicate any overdue condominium (building owners' association) charges for Lot 1.

«il complesso edilizio è autonomamente gestito dagli occupanti.»

Quote from the report (Italian), page 5 ↗
  10. State of repair

The appraiser writes that the complex's lifts, which also concern Lot 1, do not work and lack several essential components.

«Ascensori: presenti ma non funzionanti e mancanti di diversi componenti sostanziali.»

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit by cashier's cheque placed in the envelope: the notice sets the percentage (often 10%, sometimes 20%), so check it before paying.
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start

What you really need

  • Deposit: the notice sets the percentage (often 10%, sometimes 20%): check it before making the bank transfer
  • Registration tax (imposta di registro): €1,138 if first home (prima casa) (2%, minimum €1,000) or €4,771 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if you are selling a business, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much lower. Ask the sale delegate (delegato alla vendita) or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €51,900: about €54,038-€59,171
  • Estimate starting from the minimum offer: monthly instalment of about €178 with a 70% mortgage (€36,330) over 25 years at 3.3%; you need about €17,708 in savings: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the tax and fees; estimate with 10% deposit
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
