Apartment with double garage at auction in Via Concordia 9, Cusano Milanino, 173 m²

Via Concordia 9, Cusano Milanino (Milano)

The appraisal report in brief

  1. Occupancy and title

Lot 1: on the date of the inspection (21/04/2026) the property is occupied by the debtors. The appraiser does not indicate any title other than ownership.

«Alla data del sopralluogo (21/04/2026) l'immobile risulta occupato dai debitori.»

Quote from the report (Italian), page 3 ↗
  2. Restrictions and easements

Lot 1: the double box is linked by a pertinence restriction to the apartment. The appraiser writes that the garage cannot be sold separately, under penalty of nullity of the deed.

«non potrà essere ceduta separatamente dall'unità immobiliare ad uso abitazione alla quale è legat da vincolo pertinenziale, pena la nullità dell'atto di trasferimento.»

Quote from the report (Italian), page 3 ↗
  3. Planning and land-registry discrepancies

Lot 1: the appraiser finds building irregularities in the box (width and height greater than the permit) and in the basement floor. For the apartment he writes that compliance cannot be demonstrated and a regularisation application will probably be needed.

«occorrerà redigere pratica edilizia in Sanatoria e per tale motivo servirà preventivamente effettuare un'indagine più puntuale»

Quote from the report (Italian), page 6 ↗
  4. Unauthorised building works

Lot 1: the appraiser reports in the garden an underground storage room of about 4 m², of unauthorised nature and to be removed, not considered in the valuation.

«manufatto di carattere abusivo da rimuovere - non considerato nella presente stima»

Quote from the report (Italian), page 8 ↗
  5. Planning and land-registry discrepancies

Lot 1: in the cadastre the box and the apartment have dimensions and heights different from the actual state. The discrepancies can be regularised through the DOCFA procedure.

    «box di dimensioni differenti e altezza differente»

Quote from the report (Italian), page 7 ↗
  6. Other

Lot 1: the absence of the certificate of habitability could complicate the future resale of the property, and the request should be supported by documentation including a structural check of the lift shaft.

«l'assenza del certificato di agibilità potrebbe complicare la futura rivendita del bene»

Quote from the report (Italian), page 6 ↗
  7. Unpaid condominium fees

Lot 1: overdue and unpaid condominium charges at the date of the appraisal amount to €4,735.34. The appraiser asks to verify them with the administrator, as they will need to be updated at the time of the award.

«Spese condominiali scadute ed insolute alla data della perizia: €. 4.735,34»

Quote from the report (Italian), page 4 ↗
  8. Regularisation costs

Lot 1: the appraiser estimates €1,000.00 for the costs of regularising the cadastral discrepancies (technical fees and cadastral rights). For building irregularities he says the costs are included in a lump sum in the value.

    «tecnico incaricato e diritti catastali: €.1.000,00»

Quote from the report (Italian), page 7 ↗
  9. Other

Lot 1: the appraiser warns that failure to regularise the irregularities may cause problems for the future marketability of the property on the open market. No warranty for defects is recognised in the reduction of value.

«La mancata regolarizzazione delle difformità elencate potrà comportare problemi alla commerciabilità futura del bene»

Quote from the report (Italian), page 12 ↗
  10. Other

Lot 1: there are entries that the appraiser states have been cancelled by the procedure, including a voluntary mortgage and a court-ordered mortgage. The urban planning restriction in favour of the Comune remains the burden of the buyer.

«Ipoteca giudiziale, stipulata il 29/10/2019 a firma del Tribunale di Monza»

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit paid by bank transfer before the auction: the percentage is set by the notice (often 10%, sometimes 20%), so check it before paying
  • Balance of the price within the deadline set by the notice (here 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: the notice sets the percentage (often 10%, sometimes 20%): check it before making the bank transfer
  • Registration tax (imposta di registro): €7,825 if first home (2%, minimum €1,000) or €34,862 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is being sold, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: this is often much less. Ask the sale delegate (delegato alla vendita) or the notary.
  • With the value-based price (cadastral income €1,062.35), the tax would be about €2,554 for a first home / €12,147 for a second home, always including mortgage and cadastral taxes: ask the sale delegate.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €386,250: about €395,075-€423,612
  • Estimate starting from the minimum offer: monthly instalment of about €1,325 with a 70% mortgage (€270,375) over 25 years at 3.3%; about €124,700 of savings needed: the 30% not covered by the mortgage (the deposit (cauzione) you paid is part of it and is deducted from the price), the tax and the fees; estimate with a deposit of 10%
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
