Flat at auction in Via Zavaglia 22, Lainate, 40 m²

Via Zavaglia 22, Lainate (Milano)

The appraisal report in brief

  1. State of repair

Lot 1: the property is described as in complete state of abandonment, with piles of rubble and stripped plaster walls on the ground floor, and the first-floor room is not accessible because the common staircase is unstable.

«il tutto in completo stato di abbandono»

Quote from the report (Italian), page 3 ↗
  2. Planning and land-registry discrepancies

Lot 1: the appraiser writes that, in the absence of building documents proving the conversion of the rooms, it is not possible to state that the current residential use is lawful from a planning standpoint without major works.

«non è pertanto possibile affermare che l’attuale destinazione residenziale sia urbanisticamente legittima senza interventi pesanti»

Quote from the report (Italian), page 6 ↗
  3. Planning and land-registry discrepancies

Lot 1: the 1939 floor plan shows the rooms as a hayloft and cowshed, while the current cadastral classification is A/4 low-income housing, without titles proving the change of use.

«i locali risultano indicati con destinazione funzionale di “fienile e stalla”»

Quote from the report (Italian), page 6 ↗
  4. Planning and land-registry discrepancies

Lot 1: at the inspection the unit was found not compliant from a cadastral point of view.

    «Al sopralluogo l’unità risultava non conforme»

Quote from the report (Italian), page 6 ↗
  5. Regularisation costs

Lot 1: the appraiser notes the need to bear costs for works and technical and administrative charges, but in the estimate indicates €0.00 for technical regularisation costs to be borne by the buyer.

«Necessità di sostenere costi per lavori, oneri tecnici, amministrativi»

Quote from the report (Italian), page 7 ↗
  6. Regularisation costs

Lot 1: the base price for the auction is €23,000.00 after a 5% reduction for absence of warranty against defects, and the appraiser does not quantify the regularisation expenses.

«Riduzione del valore del 5% per assenza di garanzia per vizi»

Quote from the report (Italian), page 8 ↗
  7. Systems (plumbing, electrical, heating)

Lot 1: the appraiser lists among the critical issues the absence of systems and the need to verify the structural and functional conditions.

«assenza di impianti necessità di verificare le condizioni strutturali e funzionali»

Quote from the report (Italian), page 7 ↗
  8. Occupancy and title

Lot 1: at the inspection the unit was found vacant, and there are no lease contracts in force.

    «Al momento del sopralluogo l’unità è risultata libera.»

Quote from the report (Italian), page 4 ↗
  9. Unpaid condominium fees

Lot 1: the appraiser does not rule out unpaid condominium charges; he writes that the future successful bidder must check the amounts, for which the judgment debtor is jointly liable, and that the property may be in a condominium, although the on-site inspections do not suggest it.

«gravanti in via solidale con l’esecutato ex art. 63 quarto comma disp. att. c.c.»

Quote from the report (Italian), page 6 ↗
  10. Restrictions and easements

Lot 1: the property is indicated as not accessible to people with disabilities.

From the notice: Property unit, in a state of abandonment, arranged on two levels with access to the upper floor via an external shared staircase, cadastral surface area 40 m², floor T-1.

If this sale also ends with no bids (asta deserta), as a rule the judge can reduce the base price (prezzo base) by up to a quarter: at the next attempt it could start from around €17,250, with a minimum offer (offerta minima) of €12,938. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the reduction is decided by the judge, and in the meantime the lot may be awarded to someone else.

Official documents

The documents remain on the servers of the seller: here you will only find the link.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start

What you really need

  • Deposit: €1,725 (10% of the minimum offer, as the notice requires) or €2,300 if you offer the base price
  • Registration tax (imposta di registro): €1,100 if first home (prima casa) (2%, minimum €1,000) or €1,652 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if the seller is a business, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: this is often much lower. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €17,250: about €19,350-€21,402
  • Estimate starting from the minimum offer: monthly instalment of about €59 with a mortgage at 70% (€12,075) over 25 years at 3.3%; about €7,275 in savings are needed: the 30% not covered by the mortgage (the deposit paid, cauzione, is part of it and is deducted from the price), the registration tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
