Apartment for auction in Via Valleambrosia 14, Rozzano, 94 m²

Via Valleambrosia 14, Rozzano (Milano)

The appraisal report in brief

  1. Occupancy and title

Lot 1: the property is occupied and used by the owner. No lease or loan-for-use contracts are recorded, so the appraiser considers it to be in a vacant state.

«il bene è risultato occupato e in uso al proprietario»

Quote from the report (Italian), page 3 ↗
  2. Planning and land-registry discrepancies

Lot 1: the appraiser declares the property non-compliant both from a building and from a cadastral standpoint, due to an unauthorised external storage room, a wall in the bathroom and a false ceiling.

    «Conformità edilizia: NON CONFORME»

Quote from the report (Italian), page 7 ↗
  3. Unauthorised building works

Lot 1: an external storage room has been built with access from the terrace, about 2.10 metres high, about 80 cm wide and about 4 metres long, which does not appear in the cadastral floor plans.

«Realizzazione di ripostiglio esterno con accesso dal terrazzo.»

Quote from the report (Italian), page 7 ↗
  4. Regularisation costs

Lot 1: regularisation requires a building application for regularisation and the dismantling of the false ceiling. The appraiser estimates total costs of €6,000.00.

    «Sommano totale costi stimati: € 6.000,00»

Quote from the report (Italian), page 8 ↗
  5. Other

Lot 1: only the 1/2 share is subject to attachment, and the appraiser considers the property not conveniently divisible. The appraiser refers any decision on this matter to the judge.

«il sottoscritto PE ritiene che l’unità immobiliare stessa, singolarmente presa, non sia comodamente divisibile.»

Quote from the report (Italian), page 12 ↗
  6. Other

Lot 1: the appraiser applies a 5% reduction to the value for the absence of warranty against defects.

«Riduzione del valore del 5% per assenza di garanzia per vizi»

Quote from the report (Italian), page 12 ↗
  7. Systems (plumbing, electrical, heating)

«Certificazioni di conformità degli impianti Non disponibili»

Quote from the report (Italian), page 5 ↗
  8. Other

Lot 1: the Energy Performance Certificate (APE) is not present, and the building has no lift, so it is not accessible to disabled persons.

    «Attestazione APE: non presente»

Quote from the report (Italian), page 5 ↗
  9. Other

Lot 1: a voluntary mortgage registered in 2020 and an attachment registered in 2024 are recorded on the property; the procedure will cancel them at its own expense.

    «ISCRIZIONE del 08/07/2020 – Registro Particolare 13362 Registro Generale 71622»

Quote from the report (Italian), page 4 ↗
  10. Unpaid condominium fees

From the notice: Apartment for residential use located on the 1st (first) floor, comprising three rooms, kitchen, bathroom and terrace.

If this sale also gets no bids (asta deserta), the judge can generally reduce the base price (prezzo base) by up to a quarter: at the next attempt it could start from around €150,000, with a minimum offer (offerta minima) of €112,500. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the reduction is decided by the judge, and in the meantime the lot may be awarded to someone else.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit (cauzione): €15,000 (10% of the minimum offer, as the notice requires) or €20,000 if you offer the base price
  • Registration tax (imposta di registro): €3,100 if first home (prima casa) (2%, minimum €1,000) or €13,600 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes. If a business is selling, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: often it is much lower. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €150,000: around €154,100-€166,100
  • Estimate starting from the minimum offer: monthly repayment of about €514 with a mortgage covering 70% (€105,000) over 25 years at 3.3%; you need about €49,100 in savings: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the registration tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
