Apartment at auction in Via Giacomo Matteotti 48, Vaprio d'Adda, 60 m²

Via Giacomo Matteotti 48, Vaprio d'Adda (Milano)

The appraisal report in brief

  1. Occupancy and title

Lot 1: at the inspection the property appears unused but is furnished with furniture and household effects. The appraiser finds no existing lease contracts.

«Al sopralluogo inutilizzato ma occupato da arredi e suppellettili.»

Quote from the report (Italian), page 2 ↗
  2. Planning and land-registry discrepancies

Lot 1: the appraiser writes that the property complies from an urban planning standpoint but not from a building standpoint. The irregularity concerns the demolition of the dividing partition between the entrance and the kitchen/living room, with a cadastral record dated 20/01/1962.

«L’immobile è conforme dal punto di vista urbanistico ma non dal punto di vista edilizio.»

Quote from the report (Italian), page 7 ↗
  3. Regularisation costs

Lot 1: to regularise the irregularity, the appraiser indicates restoration of the partition, with estimated costs of €2,000.00.

    «Costi stimati: costi di ripristino: € 2.000,00»

Quote from the report (Italian), page 7 ↗
  4. Planning and land-registry discrepancies

Lot 1: the appraiser writes that the flat does not match the cadastral record because the dividing partition was demolished. Once the partition is restored, the record will show the actual state of the premises.

«Al sopralluogo l’alloggio risultava non conforme con quanto rappresentato sulla scheda catastale»

Quote from the report (Italian), page 7 ↗
  5. Planning and land-registry discrepancies

Lot 1: the appraiser notes that the successful bidder must take an active role and restore the dividing partition between the entrance and the living room/kitchen to bring the building into compliance.

«l’aggiudicatario dovrà farsi parte attiva e procedere al ripristino del tavolato divisorio»

Quote from the report (Italian), page 9 ↗
  6. State of repair

Lot 1: the flat is in poor condition because it has not been subject to maintenance over time. Window frames and shutters are in very bad condition, and the appraiser indicates the need for cleaning, overhaul of the systems and replacement of the finishes.

«l’alloggio riversa in carente stato conservazione per non essere stato oggetto di interventi di manutenzione nel tempo»

Quote from the report (Italian), page 4 ↗
  7. Systems (plumbing, electrical, heating)

Lot 1: the appraiser writes that the systems are obsolete and not up to standard, and that the electrical, water and heating systems need to be replaced. No certificates of conformity for the systems are on record.

    «impianti obsoleti, non a norma»

Quote from the report (Italian), page 4 ↗
  8. Systems (plumbing, electrical, heating)

Lot 1: the appraiser writes that there is no heating system, only a gas stove in the living room.

«impianto di riscaldamento: assente; è presente una stufa in soggiorno alimentata a gas»

Quote from the report (Italian), page 4 ↗
  9. Other

Lot 1: the appraiser applies a 5% reduction to the value for lack of warranty against defects. The base price (prezzo base) indicated is €40,000.00, net of this and of the other deductions.

«Riduzione del valore del 5% per assenza di garanzia per vizi»

Quote from the report (Italian), page 9 ↗
  10. Other

Lot 1: during the inspection it was not possible to access the attic belonging to the property, because the passage through the shared hallway was blocked by stacked material.

«non è stato possibile accedere al solaio in quanto il passaggio nel disimpegno comune era ostruito»

Quote from the report (Italian), page 4 ↗

From the notice: Full ownership of a first-floor residential apartment consisting of two rooms and a bathroom, with an attached undivided portion of attic used as a storage room, and with the right to the proportional share of co-ownership of the building's common parts.

If this sale also receives no bids, the judge can generally reduce the base price by up to a quarter: at the next attempt it could start from around €30,000, with a minimum offer of €22,500. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the reduction is decided by the judge and in the meantime the lot may be awarded to others.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit paid by bank transfer before the auction: the percentage is set by the notice (often 10%, sometimes 20%), so check it before paying
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: the notice sets the percentage (often 10%, sometimes 20%): check it before making the bank transfer
  • Registration tax (imposta di registro): €1,100 if first home (prima casa) (2%, minimum €1,000) or €2,800 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is being sold, VAT may apply: the notice states this. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much lower. Ask the sale delegate (delegato alla vendita) or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €30,000: around €32,100-€35,300
  • Estimate starting from the minimum offer: monthly instalment of about €103 with a 70% mortgage (€21,000) over 25 years at 3.3%; about €11,100 of savings are needed: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the registration tax and fees; estimate with deposit at 10%
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
