Country villa with land, garage and cellar at auction in Viale Paola Frassinetti 33, Oderzo, 184 m²

Viale Paola Frassinetti 33, Oderzo (Treviso)

The appraisal report in brief

  1. Occupancy and title

Single lot: the appraiser writes that the properties are not inhabited and are abandoned. He does not say who occupies them.

«I beni pignorati non risultano abitati e si presentano in stato di abbandono»

Quote from the report (Italian), page 9 ↗
  2. Planning and land-registry discrepancies

Single lot: the internal heights measured are higher than those in the cadastral documentation. The appraiser says the level of detail of the floor plans does not allow reliable metric checks.

«Le altezze interne rilevate risultano superiori a quelle desumibili dalla documentazione catastale»

Quote from the report (Italian), page 13 ↗
  3. Unauthorised building works

Single lot: on the ground floor the garage has been partly reduced to create a laundry room and the boiler room. The storage room has been divided into a cellar and a storage cupboard.

«il garage è stato parzialmente ridotto per ricavare una lavanderia e la centrale termica.»

Quote from the report (Italian), page 13 ↗
  4. Planning and land-registry discrepancies

Single lot: the appraiser believes the irregularities (increase in covered surface and in the height of the front) could be regularised with an SCIA in sanatoria (regularisation), subject to verification of the regulatory requirements. He adds that it is not binding.

«mediante presentazione di Segnalazione certificata di inizio attività in sanatoria»

Quote from the report (Italian), page 14 ↗
  5. Restrictions and easements

Single lot: the land is subject to a landscape constraint for the watercourses. The appraiser writes that for the changes to the façade a landscape compatibility check is required.

    «Vincolo Paesaggistico D.Lgs 42/2004 art. 142 - Corsi d'acqua (100%)»

Quote from the report (Italian), page 5 ↗
  6. Restrictions and easements

Single lot: the property is subject to a very high flood risk (R4) under the Piano di Gestione del Rischio di Alluvioni (Flood Risk Management Plan), which affects building possibilities.

    «Rischio idraulico molto elevato (R4)»

Quote from the report (Italian), page 6 ↗
  7. Other

Single lot: among the prejudicial charges there is a mortgage by Equitalia (now Agenzia delle Entrate Riscossione) registered on the bare ownership right. The appraiser does not indicate whether it will be cancelled.

    «nota di iscrizione iscritta a Treviso con R.G. n. 20061 e R.P. n. 3412»

Quote from the report (Italian), page 11 ↗
  8. State of repair

Single lot: during the inspection, widespread traces of mould and rising damp on the walls at ground floor were found. The appraiser points to a lack of maintenance.

«Nel corso del sopralluogo sono state riscontrate diffuse tracce di muffa»

Quote from the report (Italian), page 9 ↗
  9. Systems (plumbing, electrical, heating)

Single lot: the appraiser could not find detailed information on the systems. It is not known whether the drains are connected to the sewer.

«Non è stato possibile reperire informazioni dettagliate in merito alla dotazione impiantistica»

Quote from the report (Italian), page 8 ↗
  10. Regularisation costs

Single lot: the appraiser estimates €10,000.00 for regularising the irregularities and €3,000.00 for the possible restoration to original condition. These amounts are deducted from the market value.

«stima costi per la regolarizzazione delle difformità»

Quote from the report (Italian), page 17 ↗

Detached villa located in the Municipality of Oderzo (TV), at Viale Paola Frassinetti no. 33, specifically a dwelling cadastrally composed of: hallway, three storage rooms, cellar, laundry room and boiler room on the ground floor; entrance hall, living room, kitchen, three bedrooms, terrace and bathroom on the first floor; appurtenant garage on the ground floor and exclusive uncovered area of 860 cadastral m²; the whole in a state of neglect.

If this sale also ends as an auction with no bids (asta deserta), as a rule the judge can reduce the base price by up to a quarter: at the next attempt it could start from about €159,000, with a minimum offer (offerta minima) of €119,250. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the reduction is decided by the judge and in the meantime the lot may be awarded to others.

  1. Book the viewing via the Public Sales Portal, using the «Prenota visita» button on the official listing: by law, requests must go through there (art. 560 c.p.c.). 2. Choose how to bid: online (you need PEC, digital signature and a bank transfer for the deposit (cauzione)) or in a sealed envelope at the sale delegate's office (with a banker's cheque). Deposit: 10% of the price offered, as the notice requires.

Official documents

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the offered price (as the notice requires), by bank transfer if you bid online or with a banker's cheque in the envelope if you bid in person
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start

What you really need

  • Deposit: €15,900 (10% of the minimum offer, as the notice requires) or €21,200 if you offer the base price
  • Registration tax (imposta di registro): €3,280 if it is a first home (prima casa) (2%, minimum €1,000) or €14,410 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes. If a business is being sold, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than on the sale price: this is often much lower. Ask the sale delegate (delegato alla vendita) or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €159,000: about €163,280–€175,910
  • Estimate starting from the minimum offer: a monthly instalment of about €545 with a 70% mortgage (€111,300) over 25 years at 3.3%; you need about €51,980 in savings: the 30% not covered by the mortgage (the deposit paid is part of this and is deducted from the price), the tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
