Apartment with land and warehouse at auction in Via San Mor 37, Vittorio Veneto, 218 m²

Via San Mor 37, Vittorio Veneto (Treviso)

The appraisal report in brief

  1. Occupancy and title

Single lot: the Revenue Agency (Agenzia delle Entrate) found a rental contract for a rural plot registered on 10/01/2019, and the appraisal lists a tenant who has appeared in the proceedings. The appraisal does not say whether the contract is enforceable against the sale.

«contratto di affitto di fondo rustico del 09/01/2019 registrato a Conegliano in data 10/01/2019»

Quote from the report (Italian), page 38 ↗
  2. Unauthorised building works

Single lot: for the construction of the buildings on parcels 803 and part of 678 there were no authorisation measures. The Municipality issued a regularisation building permit in 2013.

«è stato rilasciato permesso di costruire in sanatoria n. 54 del 15 marzo 2013»

Quote from the report (Italian), page 33 ↗
  3. Planning and land-registry discrepancies

Single lot: on the open area east of the building there is a brick structure with tiles that is neither registered in the cadastre nor authorised.

«risulta edificato un manufatto in laterizio con copertura in tegole che non risulta accatastato e assentito»

Quote from the report (Italian), page 35 ↗
  4. Planning and land-registry discrepancies

Single lot: the appraiser ascertains that the unit listed under parcel 803 sub 3 no longer exists, so it does not match the land registry extract (visura catastale).

«In sede di sopralluogo lo scrivente ha accertato che l’U.I. di cui al M.N. 803 sub 3 non è più esistente.»

Quote from the report (Italian), page 36 ↗
  5. Planning and land-registry discrepancies

Single lot: in the notarial certification the buildings are described without the urban section, and the G.E. has asked for it to be indicated. The appraiser believes the supplementary filing submitted does not clarify everything.

«i richiamati mappali vengono descritti nello stesso modo, ossia senza l’indicazione della sezione urbana in cui ricadono»

Quote from the report (Italian), page 18 ↗
  6. Restrictions and easements

Single lot: the sale is made as a whole, with all active and passive easements, including those not shown in the public registers.

«con tutte le eventuali servitù attive e passive inerenti, apparenti e non»

Quote from the report (Italian), page 20 ↗
  7. Other

Single lot: there is a voluntary mortgage dated 10/05/2013 in favour of Banca Popolare dell'Alto Adige, with capital of €440,000 and a total amount of €880,000.

«IPOTECA VOLONTARJA nascente da CONCESSIONE A GARANZIA DI APERTURA DI CREDITO»

Quote from the report (Italian), page 23 ↗
  8. State of repair

Single lot: the appraiser considers the condition of the buildings mediocre. The land appears to be regularly cultivated.

«I fabbricati presentano condizioni manutentive e conservative di livello mediocre, come da documentazione fotografica allegata.»

Quote from the report (Italian), page 39 ↗
  9. State of repair

Single lot: there are leaks in the residential part, which the appraiser believes are probably due to the clay roof tiles.

«nella porzione abitative si riscontrano infiltrazioni provenienti verosimilmente dalla copertura in coppi di tipo tradizionale»

Quote from the report (Italian), page 39 ↗
  10. Regularisation costs

Single lot: the appraiser considers building works necessary to eliminate the causes of the leaks, as well as maintenance of window frames and doors, repainting, and maintenance of systems and finishes. The appraiser warns that there may be other works or charges payable by the successful bidder (aggiudicatario). No amounts are given in the extract.

    «senza escludere ulteriori interventi e/o oneri a carico dell’aggiudicatario»

Quote from the report (Italian), page 39 ↗

From the notice: vineyard with ancillary buildings: dwelling (house number 37) on the ground, first and second floors; agricultural holding totalling 30,943 m² cadastral, located in the Municipality of Vittorio Veneto (TV), in Via San Mor, specifically a plot of land of which about 17,630 m². Warehouse on the ground and first floors; tool shed on the ground and first floors. It is noted that a storage room on the ground floor has been demolished and that there are some unauthorised structures, which can be regularised (see the appraisal report (perizia)).

If this auction also ends with no bids (asta deserta), as a rule the judge can reduce the base price by up to a quarter: at the next attempt it could start from about €318,000, with a minimum offer of €238,500. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the reduction is decided by the judge and in the meantime the lot may be awarded to someone else.

Official documents

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the offered price (as the notice requires), by bank transfer if you bid online or with a banker's cheque in the envelope if you bid in person
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: €31,800 (10% of the minimum offer, as the notice requires) or €42,400 if you offer the base price
  • Registration tax (imposta di registro): €6,460 if first home (prima casa) (2%, minimum €1,000) or €28,720 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a company is being sold, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: this is often much lower. Ask the sale delegate (delegato alla vendita) or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €318,000: about €325,460-€349,220
  • Estimate starting from the minimum offer: monthly instalment of about €1,091 with a 70% mortgage (€222,600) over 25 years at 3.3%; about €102,860 of savings needed: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
