The appraisal report in brief

  1. Other

Lot 3: the property (sub 508) appears in several judicial mortgages listed in the chronology, including the one registered on 22.03.2022 in favour of the Agenzia delle Entrate Riscossione. The appraiser does not say whether they will be cancelled.

    «riguardante gli immobili distinti al C.F. al f.4 p.lla 226 subb. 502-503-505-508-511-»

Quote from the report (Italian), page 8 ↗
  2. Unauthorised building works

Lot 3: the retaining wall along Via Nemorense 1 has a conformity assessment application still to be completed, which weighs on the whole condominium (condominio). The charges are split among the properties according to millesimal shares, and for Lot 3 they are deducted from the value.

«La presente pratica grava su tutto il condominio e deve essere completata.»

Quote from the report (Italian), page 7 ↗
  3. Planning and land-registry discrepancies

Lot 3: the appraiser writes that the current state is lawful with respect to the approved plans, except for a small storage room under the stairs that is not formally recorded.

«è legittimo anche se non risulta formalmente un piccolo ripostiglio posto nel sottoscala»

Quote from the report (Italian), page 21 ↗
  4. State of repair

Lot 3: the flat has no flooring, wall coverings or finishes, including the internal doors. The appraiser states that the property is not finished and requires internal works before it can be used and certified as habitable.

«L’immobile è privo di pavimenti, rivestimenti e finiture (comprese le porte interne).»

Quote from the report (Italian), page 14 ↗
  5. Systems (plumbing, electrical, heating)

Lot 3: the heating, water and electrical systems are only partially installed, and all internal window and door frames and some sanitary fittings are missing.

«realizzati solo parzialmente l’impianto termico, idrico ed elettrico»

Quote from the report (Italian), page 14 ↗
  6. Regularisation costs

Lot 3: the appraiser estimates the cost to complete the property at €350/m² for the residential part, equal to €23,933.00, and deducts it from the market value. He also deducts €2,042.67 of charges for the wall.

«Il costo per il completamento del bene calcolato con un valore medio di € 350,00 al mq.»

From the notice: 100% ownership rights to an apartment (Floor 1 - Int. 6) in a property complex located in Nemi (RM) at Via Nemorense no. 1, known as the Domus Ninfa Egeria condominium.

If this sale also goes with no bids (asta deserta), the judge can usually cut the base price by up to a quarter: at the next attempt it could start from around €86,250, with a minimum offer (offerta minima) of €64,688. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the judge decides the reduction, and in the meantime the lot may be awarded to others.

How to take part

Irrevocable offer as set out in the terms, online on the Public Sales Portal or on the website of the sale operator. Minimum offer (offerta minima) €115,000.

  1. This is a competitive sale run by the bankruptcy receiver: read the rules (disciplinare), which set out where and how the offer is submitted. To view the property, contact the receiver: Carlo Kustermann · 069396585.
  2. The irrevocable offer is submitted as set out in the rules, online on the Public Sales Portal or on the website of the sale operator by Friday 29/01/2027 at 23:59.
  3. If you are awarded the lot (aggiudicazione), you pay the balance within the deadlines set out in the disciplinare and sign the notarial deed (rogito) with the notary; mortgages and seizures are then cancelled by decree of the delegated judge.

The public appraisal report, with photos and the condition of the property, is free and is among the attachments to the notice: read it before making an offer.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit (cauzione): 10% of the offered price, as set out in the sale rules
  • Balance payable under the disciplinare terms
  • Notary's fee for the notarial deed, payable by the buyer
  • Registration tax as in a property sale; if the bankrupt party is a company, the sale may be subject to VAT: check the sale rules
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start

What you really need

  • Deposit (cauzione): €11,500 (10% of the base price, as the notice requires)
  • Registration tax (imposta di registro): €2,400 if it is your first home (prima casa) (2%, minimum €1,000) or €10,450 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if the seller is a business, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: this is often much lower. Ask the sale delegate or the notary.
  • Notary's fee for the notarial deed (payable by the buyer), transcription and change of ownership: approximately €1,000-€2,500, more for higher amounts
  • Indicative total budget starting from €115,000: approximately €118,400-€127,950
  • Estimate starting from the base price: monthly instalment of about €394 with a 70% mortgage (€80,500) over 25 years at 3.3%; you need about €37,900 in savings: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the registration tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
