Small villa with parking space at auction in Via Rocce Anzini, Fiumicino, 89 m²

Via Rocce Anzini, Fiumicino (Roma)

The appraisal report in brief

  1. Unauthorised building works

Single lot: the appraiser describes unauthorised building works on basement floor S1 (cellar with bathroom, with increased height and volume), and for these writes that regularisation (sanatoria) cannot be requested because the area is a protected area.

«Per detta difformità non è possibile richiedere la sanatoria poiché in zona vincolata non è possibile con una sanatoria postuma regolarizzare un abuso»

Quote from the report (Italian), page 13 ↗
  2. Unauthorised building works

Single lot: on the ground floor the portico has been closed and the parking space absorbed into the flat; the appraiser writes that regularisation cannot be requested for the same reason, namely the protected-area restriction.

«Il piano Piloty dove era ubicato il posto macchina è stato chiuso ed inglobato nell'appartamento realizzando due camere e un bagno»

Quote from the report (Italian), page 13 ↗
  3. Regularisation costs

Single lot: the appraiser quantifies the works to reverse the unauthorised building works on floor S1 at €18,900.00 and those on the ground floor at €35,100.00.

«Valore delle opere di ripristino : demolizione del bagno , chiusura delle zone in ampliamento ; valore a corpo mq. 42»

Quote from the report (Italian), page 13 ↗
  4. Regularisation costs

Single lot: in the valuation, the deduction for restoring the unauthorised works is €57,000.00 and for technical procedures €5,000.00, with a final value for the property of €252,300.00 rounded to €250,000.00.

«DETRAZIONE PER MESSA IN RIPRISTINO DEGLI ABUSI €. 57.000,00»

Quote from the report (Italian), page 18 ↗
  5. Planning and land-registry discrepancies

Single lot: the appraiser writes that the cadastral floor plans comply with the approved design but not with the actual state, and that they cannot be updated because the unauthorised works cannot be regularised.

«le planimetrie catastali risultano conformi al progetto approvato ma difformi allo stato di fatto, non è possibile aggiornare le planimetrie»

Quote from the report (Italian), page 13 ↗
  6. Planning and land-registry discrepancies

Single lot: the courtyard and garden do not appear in the land registry extract because they are recorded as BCNC; attaching them to the villa would require a cadastral variation.

«sarebbe necessario fare una variazione catastale per annettere il giardino alla villetta e toglierlo da BCNC»

Quote from the report (Italian), page 13 ↗
  7. Unauthorised building works

Single lot: a small wooden structure not covered by the permits is present in the garden, to be removed at a cost of €500.00.

«Nel giardino va rimosso il piccolo vano tecnico in legno costi per la rimozione €. 500,00»

Quote from the report (Italian), page 14 ↗
  8. Restrictions and easements

Single lot: according to the appraiser, the area is subject to the PTPR landscape constraint and to an airport restriction.

«Dal punto di vista vincolistico territoriale l’area è soggetta al PTPR belle panoramiche»

Quote from the report (Italian), page 15 ↗
  9. Occupancy and title

Single lot: the property is occupied by the judgment debtor and by a son with his spouse and two grandchildren, and no lease contracts or registered private agreements appear.

«DALLA PARTE ESECUTATA E DA UN FIGLIO CON CONIUGE E DUE NIPOTI»

Quote from the report (Italian), page 15 ↗
  10. Occupancy and title

Single lot: for the lease contracts the appraiser writes ABSENT, and for the assignment of the family home NO, so no enforceable title appears.

    «Descrizione: ASSENTE»

Quote from the report (Italian), page 15 ↗
  11. Other

Single lot: the voluntary mortgage of 2004 in favour of Banca di Roma encumbers the property, and the seizure (pignoramento) of 2024 is in favour of Altea SPV.

    «Ipoteca volontaria RG. N°73349 RP n°18375 del 01/12/2004 a favore Banca di Roma»

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 20% of the price offered (the notice requires this), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: €28,125 (20% of the minimum offer, as the notice requires) or €37,500 if you offer the base price
  • Registration tax (imposta di registro): €2,912 if it is a first home (prima casa) (2%, minimum €1,000) or €12,756 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is being sold, VAT may apply: the notice says so. If you buy as a natural person and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: this is often much lower. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €140,625: approx. €144,537-€155,881
  • Estimate starting from the minimum offer: monthly instalment of about €482 with a 70% mortgage (€98,438) over 25 years at 3.3%; you need about €46,100 in savings: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
