Terraced house with garage at auction in Via Vimercate 27, Ornago, 106 m²

Via Vimercate 27, Ornago (Monza e della Brianza)

The appraisal report in brief

  1. Occupancy and title

Lot 1 (single lot): the flat is occupied by a person who, at the time of the site inspection, did not show any legal right to live there.

«risulta occupato da soggetto che all'attualità non ha dimostrato il possesso di un titolo»

Quote from the report (Italian), page 3 ↗
  2. Unauthorised building works

Lot 1: on the attic floor the appraiser reports an unauthorised bathroom and bedrooms set up unlawfully, while the attic is designated as a room lacking habitability requirements. It also reports a canopy at the entrance that is not recorded in the case documents.

«Si denuncia la presenza di un bagno non autorizzato al piano sottotetto»

Quote from the report (Italian), page 5 ↗
  3. Planning and land-registry discrepancies

Lot 1: the appraiser rates building compliance as HIGH risk. The property is non-compliant but, in his view, can be regularised. The planned works are removal of the bathroom, restoration of the attic rooms and removal or regularisation (sanatoria) of the canopy.

«L'immobile risulta non conforme, ma regolarizzabile.»

Quote from the report (Italian), page 5 ↗
  4. Regularisation costs

Lot 1: for building regularisation the appraiser estimates technical fees, penalties and works totalling €10,000.00. In the final summary he gives building regularisation costs for the irregularities of €10,700.00.

    «spese tecniche, sanzioni e opere: €.10.000,00»

Quote from the report (Italian), page 5 ↗
  5. Other

Lot 1: among the encumbrances that remain the buyer's responsibility is a judicial claim registered on 14/12/2021, relating only to unit fg.5 map.184 sub 5.

    «DOMANDA GIUDIZIALE - ESECUZIONE IN FORMA SPECIFICA»

Quote from the report (Italian), page 3 ↗
  6. Restrictions and easements

Lot 1: the appraiser writes that the appraisal report lists all the covenants, conditions and active and passive easements mentioned in the title deeds, transcriptions and registrations, which the buyer must know and accept.

«le servitù attive e passive citate negli atti di provenienza»

Quote from the report (Italian), page 3 ↗
  7. Unpaid condominium fees

Lot 1: the appraiser writes that the condominium administration (condominio) did not reply to requests, so the data on ordinary and unpaid charges have not been completed. He nevertheless indicates €0.00 for overdue charges.

«l'amministrazione condominiale non ha risposto alle richieste»

Quote from the report (Italian), page 4 ↗
  8. Planning and land-registry discrepancies

Lot 1: the garage is shown with a dividing partition from the adjacent garage which, according to the appraiser, does not exist on site. The garage is therefore communicating with the neighbouring one. For the change declaration the appraiser estimates €700.00.

Official documents

The documents remain on the servers of the seller: here you will only find the link.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: €14,950 (10% of the minimum offer, as the notice requires) or €19,870 if you offer the base price
  • Registration tax (imposta di registro): €3,090 if first home (prima casa) (2%, minimum €1,000) or €13,555 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a company is selling, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much less. Ask the sale delegate or the notary.
  • Using the price-value (cadastral income €494.45), the tax would be about €1,242 for a first home / €5,707 for a second home, always including mortgage and cadastral taxes: ask the sale delegate.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €149,500: about €153,590-€165,555
  • Estimate starting from the minimum offer: monthly instalment of about €513 with a mortgage covering 70% (€104,650) over 25 years at 3.3%; you need about €48,940 in savings: the 30% not covered by the mortgage (the deposit paid is part of this and is deducted from the price), the registration tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
