Apartment at auction in Via San Giovanni Evangelista 14, Cesano Maderno, 37 m²

Via San Giovanni Evangelista 14, Cesano Maderno (Monza e della Brianza)

The appraisal report in brief

  1. Occupancy and title

Lot 1: at the inspection the property was found vacant. Access took place by forced entry by the court-appointed custodian (custode) due to the owner being untraceable.

    «Alla data del sopralluogo l'immobile risulta libero.»

Quote from the report (Italian), page 3 ↗
  2. Planning and land-registry discrepancies

Lot 1: the appraiser states that the conformity assessments are based only on the documentation found, and that any discrepancies with titles not consulted can be regularised only if conformity existed at the time of construction and of the application for regularisation (sanatoria).

«eventuali difformità rilevabili da titoli non consultati potranno comunque essere sanate qualora sussista la conformità»

Quote from the report (Italian), page 6 ↗
  3. Unauthorised building works

Lot 1: the conversion of the cellar into a dwelling is subject to an amnesty application filed in 2004; the condominium challenged the conversion with a lawsuit rejected in 2013, and the appraiser draws particular attention to the residential use.

«sulla destinazione d'uso ad abitazione si presti particolare attenzione anche alla domanda giudiziale»

Quote from the report (Italian), page 5 ↗
  4. Unauthorised building works

Lot 1: the variations subsequent to the building permit were rejected by the Comune, which in 1996 did not authorise the change of use of the cellars to offices.

«con respingimento del 09/12/1996 non venne autorizzato il richiesto cambio d'uso»

Quote from the report (Italian), page 5 ↗
  5. Restrictions and easements

Lot 1: the title deeds reveal an electricity line easement in favour of ENEL burdening the original land.

    «servitù di elettrodotto a favore dell'ENEL, gravante»

Quote from the report (Italian), page 5 ↗
  6. Unpaid condominium fees

Lot 1: the administrator has not provided documentation on payment of condominium charges, so the amount of unpaid charges, especially for the last two years, must be verified. The appraiser indicates €0 for overdue charges, but without documents.

    «non ha trasmesso quanto richiesto.»

Quote from the report (Italian), page 4 ↗
  7. Systems (plumbing, electrical, heating)

Lot 1: conformity documentation has not been found for heating, gas, electrical and drainage systems. The appraiser writes that the heating system needs to be fully overhauled.

    «l'impianto di riscaldamento è totalmente da rivedere»

Quote from the report (Italian), page 18 ↗
  8. Regularisation costs

Lot 1: the appraiser indicates regularisation costs of €0, although declaring that the costs may be changed during the investigation and that demolition could be necessary with comparable or higher costs.

«con costi paragonabili ed eventualmente superiori a quelli indicati»

Quote from the report (Italian), page 6 ↗
  9. State of repair

Lot 1: internal height of 2.40 metres and non-compliant air and light ratios; for this reason the appraiser did not apply the market price for homes 2.70 metres high.

    «non sono rispettati i rapporti di aereolluminazione»

Quote from the report (Italian), page 2 ↗
  10. Other

Lot 1: the estimate excludes the examination of hazardous substances such as asbestos and formaldehyde and of hidden defects; the successful bidder accepts any damage from hidden defects.

«La stima di valore esclude specificatamente l’esame dell’impatto ambientale derivante»

Quote from the report (Italian), page 6 ↗

This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the judge decides the reduction, and in the meantime the lot may be awarded to someone else.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit paid by bank transfer before the auction: the percentage is set by the notice (often 10%, sometimes 20%), so check it before paying
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start

What you really need

  • Deposit: the notice sets the percentage (often 10%, sometimes 20%): check it before making the bank transfer
  • Registration tax (imposta di registro): €1,100 if it is a first home (prima casa) (2%, minimum €1,000) or €2,598 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is being sold, VAT may apply: the notice will say so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much lower. Ask the delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €27,750: about €29,850–€32,848
  • Estimate starting from the minimum offer: monthly instalment of about €95 with a mortgage covering 70% (€19,425) over 25 years at 3.3%; about €10,425 in savings needed: the 30% not covered by the mortgage (the deposit already paid, cauzione, is part of it and is deducted from the price), the registration tax and the fees; estimate with a deposit of 10%
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
