Villa with garage and cellar at auction in Via Banfi 6/8, Vimercate, 324 m²

Via Banfi 6/8, Vimercate (Monza e della Brianza)

The appraisal report in brief

  1. Occupancy and title

Lot 1: the property is occupied by the debtor, but the current owner has let one bedroom with shared use of the kitchen and bathroom, under a lease running from 12/03/2024 to 12/03/2028, renewable for another 4 years, at a rent of €250.00 per month.

«viene locata una porzione dell'unità immobiliare, in particolare una camera da letto»

Quote from the report (Italian), page 3 ↗
  2. Unauthorised building works

Lot 1: the appraiser states that the basement has been extended by about 1 metre and is taller than authorised. The original 1966 building permit did not provide for a basement.

«la licenza originaria del 1966 NON prevedeva un piano interrato.»

Quote from the report (Italian), page 7 ↗
  3. Planning and land-registry discrepancies

Lot 1: according to the appraiser, the building compliance shows internal and external discrepancies, with medium criticality, and the property is non-compliant but can be regularised. The discrepancies also concern the extension of the basement, which is not included in the regularisation.

«L'immobile risulta non conforme, ma regolarizzabile.»

Quote from the report (Italian), page 7 ↗
  4. Regularisation costs

Lot 1: the appraiser gives regularisation costs for the discrepancies of €7,672.00 in total. They include the items for the technician's fee, penalty and charges listed in chapter 8.

«Spese di regolarizzazione delle difformità (vedi cap.8):»

Quote from the report (Italian), page 22 ↗
  5. Planning and land-registry discrepancies

Lot 1: comparing the cadastral map with the site shows that part of the property, along Via Banfi, may be occupied by a pavement or half of the road carriageway. The appraiser recommends a topographic survey, costing €1,500.00, plus a subdivision application for €1,000.00.

«Pare che parte della proprietà come da mappa catastale, sia occupata da marciapiede e/o semisede stradale.»

Quote from the report (Italian), page 8 ↗
  6. State of repair

Lot 1: according to the appraiser, the interior is in fair condition, while the external façade requires extraordinary maintenance work.

«la facciata esterna invece necessita di qualche intervento di manutenzione straordinaria»

Quote from the report (Italian), page 12 ↗
  7. State of repair

Lot 1: the appraiser finds water infiltration in the ceilings of the first and ground floors, coming from the roof or the balconies. Tall trees make the problem worse because they block the gutters.

«negli intradossi delle solette, si sono rilevate alcune infiltrazioni»

Quote from the report (Italian), page 12 ↗
  8. Planning and land-registry discrepancies

Lot 1: the ground floor is designated non-residential, but at the inspection it was found in use as a dwelling, with kitchen furnishings, a living area and bedrooms.

«il piano terra è effettivamente utilizzato ai fini abitativi»

Quote from the report (Italian), page 11 ↗

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit paid by bank transfer before the auction: the percentage is set by the notice (often 10%, sometimes 20%), so check it before paying
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: the notice sets the percentage (often 10%, sometimes 20%): check it before making the bank transfer
  • Registration tax (imposta di registro): €10,015 if first home (prima casa) (2%, minimum €1,000) or €44,718 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a company is selling, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the sale price: often much less. Ask the sale delegate or the notary.
  • With the price-value (cadastral income €1,785.39) the tax would be about €4,224 for a first home / €20,346 for a second home, always including mortgage and cadastral taxes: ask the sale delegate.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €495,750: about €506,765-€542,968
  • Estimate starting from the minimum offer: monthly instalment of about €1,700 with a mortgage at 70% (€347,025) over 25 years at 3.3%; about €159,740 of savings needed: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the registration tax and fees; estimate with a 10% deposit
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
