Warehouse at auction in Via Matteotti 3, Sant'Ambrogio di Valpolicella

Via Matteotti 3, Sant'Ambrogio di Valpolicella (Verona)

The appraisal report in brief

  1. Occupancy and title

Lot 1 (former sub 9, shop): it is leased to Shafik Khalid for the sale of pizza and kebab, under a contract from 01.11.2017 to 31.10.2023. The appraiser writes that the contract could be enforceable against the proceedings, but it has no certain date because it is not registered.

«il contratto consegnato non riporta registrazione dell’Agenzia delle entrate e quindi, non ha data certa.»

Quote from the report (Italian), page 18 ↗
  2. Planning and land-registry discrepancies

The appraiser says that the cadastral identifications do not conform between the actual state of the premises and the cadastral floor plan, and that it was possible to update them. He also says that, due to a lack of plans, it was not possible to verify urban planning compliance.

«difficile è STATO verificare la conformità urbanistica per mancanza di progetti.»

Quote from the report (Italian), page 12 ↗
  3. Unauthorised building works

Lot 2 (former sub 74, now sub 97+76): the basement has been merged with other sub-units without authorisation from the authorities. The appraiser writes that a SCIA regularisation (sanatoria) is needed to regularise it.

«Tali accessori nascono dalla fusione di altri subalterni senza permesso autorizzato da parte degli enti preposti.»

Quote from the report (Italian), page 22 ↗
  4. Restrictions and easements

There is a right of way easement over parcels 84 and 78, which according to the appraiser are not part of the seized assets. By agreement of 21.07.2020 the passage has been moved.

    «risulta l’esistenza di SERVITU’ DI PASSO sui mappali n. 84 e 78»

Quote from the report (Italian), page 13 ↗
  5. Unpaid condominium fees

There is no constituted condominium (building owners' association) nor any administrator. According to the appraiser, the property's management costs were not regularly paid, and for this reason the lighting of the common areas was removed.

«Le spese annue di gestione dell’immobile, non venivano regolarmente pagate»

Quote from the report (Italian), page 12 ↗
  6. State of repair

The appraiser writes that the finishing materials are poorly maintained and that there is dampness and infiltration, including in the garages. He also writes that the external areas are abandoned.

«Lo stato dei materiali di finitura presenta scarsa manutenzione.»

Quote from the report (Italian), page 16 ↗
  7. Systems (plumbing, electrical, heating)

The appraiser writes that there are no system certifications for any of the units. For Lot 1, compliance of the electrical and water systems is missing.

«NON vi sono le certificazioni degli impianti per nessuna delle unità immobiliari»

Quote from the report (Italian), page 16 ↗
  8. Other

Lot 1 (former sub 9): the company Habitat has reserved the surface right to build on the roof slab of the basement level, above sub-units 78 and 80.

«DI RISERVARSI IL DIRITTO DI SUPERFICIE, ALLORCHE' LA PARTE ACQUIRENTE»
