Via Apollo 4, Anzio (Roma)

The appraisal report in brief

  1. Occupancy and title

Single lot: the property is occupied by the debtor, without the appraisal report indicating any different title of occupancy.

«L'immobile risulta occupato dal soggetto esecutato.»

Quote from the report (Italian), page 8 ↗
  2. Unauthorised building works

Single lot: the storage room/utility room in the yard and the veranda on the roof level are unauthorised structures that the appraiser indicates as not regularisable.

«Il magazzino insistente sulla corte tra il fabbricato e la recinzione e la veranda al piano copertura sono manufatti abusivi non sanabili.»

Quote from the report (Italian), page 17 ↗
  3. Planning and land-registry discrepancies

Single lot: the differences between the permit drawings and the actual state of the premises are essential variations considered unlawful and not regularisable; the appraiser writes that they must be removed and demolished, subject to the possibility of a financial penalty at the discretion of the competent body.

«sono da ritenere illegittime e non sono sanabili»

Quote from the report (Italian), page 13 ↗
  4. Planning and land-registry discrepancies

Single lot: the latest cadastral floor plan does not match the actual state of the premises; the ground-floor WC is missing, which the appraiser considers regularisable through a C.I.L.A. with a regularisation (sanatoria) penalty of €1,000.

Quote from the report (Italian), page 7 ↗
  5. Regularisation costs

Single lot: the appraiser applies a 5% deduction for urban planning regularisation costs, and specifies that all costs, expenses and penalties for regularisation are the responsibility of the successful bidder.

Quote from the report (Italian), page 13 ↗

Single lot: no system is certified; declarations of conformity for the electrical, heating and water systems are missing, and the APE is missing.

«Non esiste la dichiarazione di conformità dell'impianto elettrico.»

Quote from the report (Italian), page 12 ↗
  7. Restrictions and easements

Single lot: the appraiser writes that the building was constructed without a permit in 1980 and was later regularised with a regularisation (sanatoria) permit; the regularisation is cited as a historical reference.

From the notice: Apartment in a multi-family small villa, on the ground and first floors, comprising entrance hall, living room, kitchen, three rooms, two bathrooms and an additional toilet, plus porch, veranda, loggia and garden.

If this sale also ends with no bids (asta deserta), the judge can normally cut the base price (prezzo base) by up to a quarter: at the next attempt it could start from around €174,750, with a minimum offer (offerta minima) of €131,062. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the judge decides the reduction and in the meantime the lot may be awarded to others.

How to take part

Online offer digitally signed and sent by certified email (PEC) via the Public Sales Portal. Minimum offer (offerta minima) €174,750.

  1. Book your viewing through the Public Sales Portal, using the «Book viewing» button on the official listing: by law, requests must go through it (art. 560 c.p.c.). Court-appointed custodian (custode): Francesco Corsi · 0694315905. You can call the custodian with questions about the property. Read the attached appraisal report.
  2. Prepare PEC, digital signature, ID document and the bank transfer for the deposit (10% of the price you offer, as the notice requires).

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Occupied by the debtor: the court-appointed custodian handles the vacating on the judge's order; allow a few months before you can move in

What you really need

  • Deposit: €17,475 (10% of the minimum offer, as the notice requires) or €23,300 if you offer the base price
  • Registration tax (imposta di registro): €3,595 for a first home (prima casa, 2%, minimum €1,000) or €15,828 in other cases (9%, minimum €1,000), already including €100 in mortgage and cadastral taxes; if a company is selling, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value rather than the price: often it is much lower. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €174,750: around €179,345-€193,078
  • Estimate starting from the minimum offer: monthly instalment of around €599 with a 70% mortgage (€122,325) over 25 years at 3.3%; you will need around €57,020 in savings: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the registration tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
