Velletri · 129 m² · Apartment

1/2 share of apartment at auction in Via Papazzano 143, Velletri, 129 m²

Via Papazzano 143, Velletri (Roma)

The appraisal report in brief

  1. Planning and land-registry discrepancies

Single Lot: the external area is in an ambiguous situation. The cadastral records and the purchase deed of the judgment debtors show it as exclusively belonging to the ground floor, while the sale deed for the second-floor flat makes it common with that flat. It is now divided into three portions.

«Come detto in precedenza esiste una ambiguità legata all'area esterna.»

Quote from the report (Italian), page 7 ↗
  2. Planning and land-registry discrepancies

Single Lot: the appraiser writes that cadastral changes must be prepared before the property is assigned, otherwise the cadastral compliance requirement would not be met. The changes were not submitted at the CTU stage.

«è necessario procedere alla predisposizione delle dovute variazioni catastali»

Quote from the report (Italian), page 8 ↗
  3. Unauthorised building works

Single Lot: only one amnesty application (condono) is pending, still being processed. The outcome of the regularisation depends on submitting the missing documentation and paying the amounts still due.

«Per gli immobili in esame è stata depositata domanda di condono protocollo 41321 del 29/09/1985»

Quote from the report (Italian), page 12 ↗
  4. Regularisation costs

Single Lot: the Municipality has not quantified the sums still to be paid for the oblazione and the charges. The file shows that only the first instalment of the oblazione, Lire 307,130 out of a total of Lire 4,913,964, has been paid. The appraiser cannot state the total cost.

«non vengono quantificati però né le somme ancora da versare per l'oblazione»

Quote from the report (Italian), page 12 ↗
  5. Regularisation costs

Single Lot: the appraiser deducted from the valuation €2,000 for professional fees, €4,000 for building concession charges and €7,000 for the oblazione, all approximate estimates. The final auction base price (prezzo base) is €222,000.

«Prestazioni professionali per elaborati integrativi alla domanda di condono»

Quote from the report (Italian), page 14 ↗
  6. Occupancy and title

Single Lot: at the time of the inspections the property was fully at the disposal of the judgment debtor. The appraiser does not indicate any other occupants or occupation titles.

«L'immobile, al momento dei sopralluoghi era a completa disposizione dell'esecutato.»

Quote from the report (Italian), page 9 ↗
  7. Other

Single Lot: the proceedings formally concern only half of the property, but the appraiser writes that the attachment covers 100%. The summary instead indicates a 1/2 share. The share actually sold therefore remains uncertain.

«La quota di proprietà oggetto del pignoramento è quindi pari al 100%.»

Quote from the report (Italian), page 5 ↗
  8. Systems (plumbing, electrical, heating)

Single Lot: there is no declaration of conformity for the electrical system. Those for the heating and plumbing systems are also missing, and no energy certificate (APE) is on record.

«Non esiste la dichiarazione di conformità dell'impianto elettrico.»

Quote from the report (Italian), page 13 ↗
  9. State of repair

Single Lot: the external window frames are in poor condition. The warehouse room has no flooring. Otherwise the appraiser describes normal conditions for a building from the '80s.

«Gli infissi esterni sono in cattive condizioni.»

Quote from the report (Italian), page 8 ↗
  10. Restrictions and easements

Single Lot: among the common parts there is an underground LPG gas tank, located in the portion of land used by the judgment debtors. A water tank with pump and a boiler room are also common; the boiler room is in the fenced area of the owners on the second floor.

«un deposito di gas GPL (cd bombolone) interrato e posto nella porzione di terreno utilizzata dagli»

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: €7,028 (10% of the minimum offer, as the notice requires) or €9,370 if you offer the base price
  • Registration tax (imposta di registro): €1,506 if first home (prima casa) (2%, minimum €1,000) or €6,425 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a company is selling, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: this is often much lower. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • On a share or on bare ownership, banks as a rule do not grant a mortgage: plan to pay everything with your own funds by the balance deadline. Indicative budget: €72,781–€79,200.
  • The notice on the share stated above applies.
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
