The appraisal report in brief

  1. Unauthorised building works

The appraiser writes that the existing buildings, including those where the commercial premises are located, are in every respect unauthorised, because the 1971 licences were declared unlawful by the administrative courts.

«Per quanto detto, le costruzioni esistenti, in cui sono tra gli altri inseriti i locali commerciali di nostro interesse, sono a tutti gli effetti abusive.»

Quote from the report (Italian), page 36 ↗
  2. Unauthorised building works

The appraiser writes that the amnesty applications were submitted in 1986, but that a new nulla osta must now be obtained, as the previous one has expired.

«Ad oggi si rende comunque necessario procedere ad una nuova acquisizione del nulla osta scaduto»

Quote from the report (Italian), page 37 ↗
  3. Planning and land-registry discrepancies

The appraiser writes that all the units of the Comune of Cerveteri in the locality of Campo di Mare must be regularised (sanatoria) under the Variante Speciale to the PRG adopted by resolution C.C. no. 37 of 6 August 2021. This is the premise on which the valuation is based.

«dovranno essere tutte sanate in conformità a quanto previsto nella Variante Speciale»

Quote from the report (Italian), page 28 ↗
  4. Unauthorised building works

The appraiser cites a resolution of 1979 under which, within 300 metres of the sea, licences not yet used could not be the subject of regularisation (sanatoria).

«non potevano essere oggetto di sanatoria»

Quote from the report (Italian), page 35 ↗
  5. Restrictions and easements

The appraiser writes that the properties subject to the amnesty (condono) application fall within a protected area, namely the coastal strip. For this reason, the Comune has set an environmental damage value.

«gli immobili oggetto di domanda ricadono in ambito vincolato (fascia costiera)»

Quote from the report (Italian), page 38 ↗
  6. State of repair

The appraiser describes the square where the properties are located as semi-abandoned and only partly paved.

«attualmente in stato di semi/abbandono, solo in parte pavimentata»

Quote from the report (Italian), page 30 ↗
  7. Planning and land-registry discrepancies

In the cadastral list, for parcel 530 Piazza Primarosa, the appraiser indicates a sub-unit with interior 4 as not registered, and therefore without cadastral income.

    «foglio 53 part. 530 sub - Piazza Primarosa PT int. 4 non censito»

Quote from the report (Italian), page 4 ↗
  8. Other

The appraiser writes that the company has paid all the environmental damage, but has not completed the urbanisation works. For this reason, the Comune has not yet received ownership of the public areas.

«e quindi non era stato possibile effettuare il passaggio della proprietà delle aree pubbliche»

Quote from the report (Italian), page 39 ↗
