Apartment at auction in Via Tirso 59, Pomezia, 51 m²

Via Tirso 59, Pomezia (Roma)

The appraisal report in brief

  1. Occupancy and title

Single lot: the property is occupied by third parties without title. During the site inspection the debtor declared that they occupy it with another person rent-free, without a rental contract or any other title.

«L'immobile risulta occupato da terzi senza titolo.»

Quote from the report (Italian), page 9 ↗
  2. Unauthorised building works

Single lot: the appraiser writes that the closing of the stairwell on the ground floor and of the patio on the first floor results in an increase in volume and cannot be regularised, because it does not meet the double conformity requirement.

«questi NON risultano sanabili in quanto rappresentano un aumento di volumetria»

Quote from the report (Italian), page 13 ↗
  3. Unauthorised building works

Single lot: the appraiser writes that the wooden pergola built at the stairwell does not respect the distances from the boundaries and is also not regularisable, because it was built without the necessary landscape permit.

«l'abuso 2) ossia la realizzazione del pergolato è ugualmente NON sanabile»

Quote from the report (Italian), page 13 ↗
  4. Planning and land-registry discrepancies

Single lot: the appraiser indicates that there is no cadastral correspondence and that the actual state differs from the cadastral floor plan; the cadastre has not been updated for the non-compliant works.

    «Non sussiste corrispondenza catastale.»

Quote from the report (Italian), page 6 ↗
  5. Regularisation costs

Single lot: the appraiser deducts €6,629.40 from the valuation for restoring the works not compliant with the original building licence.

«spese per il ripristino delle opere NON conformi alla licenza edilizia originaria (si veda all 12) = 6.629,40 €»

Quote from the report (Italian), page 15 ↗
  6. Unpaid condominium fees

Single lot: the appraiser writes that the foreclosure debtor owes the condominium €2,919.52.

«da questo risulta un debito nei confronti del condominio pari a 2.919,52 €»

Quote from the report (Italian), page 14 ↗
  7. Restrictions and easements

Single lot: the appraiser writes that the property falls within a landscape restriction for a buffer strip along watercourses; any external alteration requires a landscape Nulla Osta.

«rappresenta un vincolo paesaggistico; pertanto qualsiasi modifica esterna»

Quote from the report (Italian), page 12 ↗
  8. Other

Single lot: mortgages and seizures remain registered, which the appraiser lists among the formalities to be cancelled with the transfer decree, including a voluntary mortgage of €210,000 and a mortgage in renewal of €108,455.95.

«Formalità da cancellare con il decreto di trasferimento»

Quote from the report (Italian), page 2 ↗
  9. Systems (plumbing, electrical, heating)

Single lot: the gas has been disconnected, there is no radiator heating system and it was not possible to find the system logbook, so it is not possible to draw up the APE.

«Non è stato possibile reperire il libretto di impianto e pertanto non è possibile procedere alla redazione»

Quote from the report (Italian), page 9 ↗
  10. State of repair

Single Lot: the appraiser reports traces of mould in some places, wooden window frames with single glazing that are not energy-efficient, and outdated flooring and wall coverings.

«in alcuni punti ci sono tracce di muffa»

Quote from the report (Italian), page 5 ↗

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Occupied by the debtor: the court-appointed custodian handles the vacating on the judge's order; allow a few months before you can move in

What you really need

  • Deposit: €5,175 (10% of the minimum offer, as the notice requires) or €6,900 if you bid the base price
  • Registration tax (imposta di registro): €1,135 if first home (2%, minimum €1,000) or €4,758 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is selling, VAT may apply: the notice will say so. If you are buying as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the sale price: this is often much lower. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €51,750: approx. €53,885–€59,008
  • Estimate starting from the minimum offer: monthly instalment of about €177 with a mortgage at 70% (€36,225) over 25 years at 3.3%; about €17,660 in savings needed: the 30% not covered by the mortgage (the deposit paid, cauzione, is part of it and is deducted from the price), the registration tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
