Apartment at auction in Via Nemorense 1, Nemi, 41 m²

Via Nemorense 1, Nemi (Roma)

The appraisal report in brief

  1. Occupancy and title

Lot 1: the appraiser does not state who occupies the flat or under what title. It only writes that the current rent is declared by the tenant for Asset 2 (Lot 1 is Asset 1, so this point does not concern Lot 1).

«Si prende in considerazione € 800,00 che è il canone attuale dell’affittuario, come dichiarato dallo stesso»

Quote from the report (Italian), page 20 ↗
  2. Planning and land-registry discrepancies

Lot 1 (Asset 1): the appraiser writes that the current state is lawful except for an opening on the short side of the cavity, which must be closed to complete the works.

«Rispetto al progetto approvato lo stato attuale dell’appartamento è legittimo ad esclusione di una bucatura presente sul lato corto dell’intercapedine»

Quote from the report (Italian), page 14 ↗
  3. State of repair

Lot 1 (Asset 1): the flat is not finished, with only partial systems, missing internal window frames, some sanitary fittings missing, and no floors or finishes.

«sono realizzati solo parzialmente l’impianto termico, idrico ed elettrico, mancano tutti gli infissi interni ed alcuni sanitari»

Quote from the report (Italian), page 14 ↗
  4. Systems (plumbing, electrical, heating)

Lot 1 (Asset 1): the heating, water and electrical systems are only partially completed.

«sono realizzati solo parzialmente l’impianto termico, idrico ed elettrico»

Quote from the report (Italian), page 14 ↗
  5. Regularisation costs

Lot 1 (Asset 1): the appraiser deducts from the value €19,242.00 for completion (€450/m² over 42.76 m²) and €2,067.93 as its share of the wall costs.

«Il costo per il completamento del bene calcolato con un valore medio di € 450,00 al mq.»

Quote from the report (Italian), page 17 ↗
  6. Regularisation costs

Lot 1 (Asset 1) and the whole condominium: the regularisation of the retaining wall in Via Nemorense must be completed with a penalty of €40,314.00 and registry fees of €1,000.00, to be divided among the properties.

    «Versamento della sanzione oblatoria art. 36 DPR 380/2001 (art. 22 comma 2) lettera a bis) e s.m.i. per €. 40.314,00»

Quote from the report (Italian), page 7 ↗
  7. Unauthorised building works

The regularisation (accertamento di conformità) for the retaining wall affects the whole condominium and must be completed with the payments indicated.

«La presente pratica grava su tutto il condominio e deve essere completata.»

Quote from the report (Italian), page 7 ↗
  8. Restrictions and easements

Lot 1 (Asset 1) and the complex: the appraiser cites a restriction by the Park Authority (Ente Parco) for the laundry room of Asset 4, while for Lot 1 no specific restrictions are found in the text.

    «il bene ricade nel vincolo dall’Ente Parco»

Quote from the report (Italian), page 26 ↗
  9. Other

Lot 1 (Asset 1): the appraiser does not list mortgages on the asset at this point; the mortgages and attachments affect the complex (sub 503 included in Asset 1; judicial mortgages and a judicial act dated 10.12.2022).

    «Atto giudiziario - Reg. Part. 1756 – Reg. Gen. 2569 – Tribunale di Velletri»

From the notice: 100% ownership rights to an apartment (Floor S1 - Int. 1) in a property complex located in Nemi (RM) at Via Nemorense no. 1, called Domus Ninfa Egeria condominium.

If this auction also receives no bids (asta deserta), as a rule the judge can reduce the base price (prezzo base) by up to a quarter: at the next attempt it could start from around €52,500, with a minimum offer (offerta minima) of €39,375. This is the maximum allowed by law (art. 591 c.p.c.), not a forecast: the reduction is decided by the judge and in the meantime the lot may be awarded to others.

How to take part

Irrevocable offer as the terms of sale indicate, online on the Public Sales Portal or on the website of the sale operator. Minimum offer (offerta minima): €70,000.

  1. This is a competitive sale run by the bankruptcy receiver: read the rules (disciplinare), which set out where and how the offer is submitted. To view the property, contact the receiver: Carlo Kustermann · 069396585.
  2. The irrevocable offer is submitted as set out in the rules, online on the Public Sales Portal or on the website of the sale operator by Friday 29/01/2027 at 23:59.
  3. If you are awarded the lot (aggiudicazione), you pay the balance within the deadlines set out in the disciplinare and sign the notarial deed (rogito) with the notary; mortgages and seizures are then cancelled by decree of the delegated judge.

The public appraisal report, with photos and the condition of the property, is free and is among the attachments to the notice: read it before making an offer.

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit (cauzione): 10% of the offered price, as set out in the sale rules
  • Balance payable under the disciplinare terms
  • Notary's fee for the notarial deed, payable by the buyer
  • Registration tax as in a property sale; if the bankrupt party is a company, the sale may be subject to VAT: check the sale rules
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start

What you really need

  • Deposit: €7,000 (10% of the base price, as the notice requires)
  • Registration tax (imposta di registro): €1,500 if first home (prima casa) (2%, minimum €1,000) or €6,400 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if the seller is a business, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: often much less. Ask the sale delegate or the notary.
  • Notary's fee for the notarial deed (payable by the buyer), transcription and change of ownership: approximately €1,000-€2,500, more for higher amounts
  • Indicative total budget starting from €70,000: approximately €72,500-€78,900
  • Estimate starting from the base price: instalment of around €240 a month with a 70% mortgage (€49,000) over 25 years at 3.3%; around €23,500 of savings needed: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
