Apartment at auction at Via Due Pini 1, Anzio, 105 m²

Via Due Pini 1, Anzio (Roma)

The appraisal report in brief

  1. Occupancy and title

Single Lot: the property is occupied by third parties under a lease that the appraisal defines as binding on the buyer. The tenant is Mr Omissis, who lives in the property with his family.

«L'immobile risulta occupato da terzi con contratto di locazione opponibile.»

Quote from the report (Italian), page 8 ↗
  2. Occupancy and title

Single Lot: the lease registered on 12/11/2021 (expiry 30/10/2025, monthly rent €350.00) has not been transferred after the change of ownership. According to the tenant, he has not paid rent to the current owner for some time.

«A seguito del passaggio di proprietà dalla citata società all'attuale esecutata, il contratto di locazione non è stato volturato.»

Quote from the report (Italian), page 8 ↗
  3. Planning and land-registry discrepancies

Single Lot: urban-planning irregularities were found for internal alterations (partitions removed or moved) and external frames removed or moved, without a building permit. The appraiser indicates as a remedy a SCIA in regularisation (sanatoria).

«Tali difformità consistono nella effettuazione di modifiche nella configurazione degli ambienti interni mediante l'abbattimento/spostamento di alcune tramezzature.»

Quote from the report (Italian), page 11 ↗
  4. Planning and land-registry discrepancies

Single Lot: the cadastral floor plan does not match the actual state. The appraiser has prepared the necessary cadastral changes.

«sono state rilevate difformità nella configurazione in pianta dell'unità immobiliare»

Quote from the report (Italian), page 6 ↗
  5. State of repair

Single Lot: the property as a whole is not in good state of maintenance. Floors are damaged and loose with traces of damp on the ground floor, leaks and damp on the first floor with detached plaster on the balconies, and an abandoned garden.

«L'immobile nel suo insieme non si presenta in buono stato di manutenzione»

Quote from the report (Italian), page 7 ↗
  6. Unpaid condominium fees

Single Lot: the appraiser could not contact the condominium (condominio) administrator and therefore could not check any arrears. Nor did he obtain the millesimal tables or the condominium regulations.

«non è stato più possibile interloquire con lo stesso»

Quote from the report (Italian), page 7 ↗
  7. Unpaid condominium fees

Single Lot: the appraiser writes that unpaid condominium (condominio) charges for the last two years will be payable by the buyer. They have not been quantified because the administrator did not reply.

«a carico dell'assegnatario saranno posti gli eventuali oneri condominiali non pagati»

Quote from the report (Italian), page 14 ↗
  8. Systems (plumbing, electrical, heating)

Single Lot: the declarations of conformity for the electrical, heating and water systems are missing, and the APE is missing too. The appraiser writes that the APE will be essential at the time of the award (aggiudicazione).

«Non esiste la dichiarazione di conformità dell'impianto elettrico.»

Quote from the report (Italian), page 11 ↗
  9. Regularisation costs

Single Lot: the appraised value of €118,650.00 is reduced to €109,650.00 (base auction price, prezzo base d'asta). The reduction is €4,000.00 for urban-planning regularisation costs and €5,000.00 for the state of maintenance.

«Il prezzo determinato a stima dei beni è stato però ridotto per compensare la situazione urbanistica non rispondente alla realtà»

Costs and conditions to factor in

The items below are the general rules for this type of sale: the exact figures are in the notice linked at the bottom.

  • Deposit: 10% of the price offered (as the notice requires), paid by bank transfer before the auction
  • Balance of the price within the deadline set by the notice (at most 120 days from the award)
  • Registration tax or VAT as in a standard sale; plus the share of the sale delegate's fee for the transfer and the costs of registering the transfer decree
  • No commission to pay to the court or the seller. If you choose our assisted service, the fee is separate and we will tell you in writing before we start
  • Anyone occupying without title will be removed by the court-appointed custodian, and the timing should be factored in

What you really need

  • Deposit: €6,582 (10% of the minimum offer, as the notice requires) or €8,776 if you offer the base price
  • Registration tax (imposta di registro): €1,416 if first home (prima casa) (2%, minimum €1,000) or €6,024 in other cases (9%, minimum €1,000), already including €100 of mortgage and cadastral taxes; if a business is selling, VAT may apply: the notice says so. If you buy as a private individual and the sale is not subject to VAT, you can ask for the tax to be calculated on the cadastral value instead of the price: often much less. Ask the sale delegate or the notary.
  • Share of the sale delegate's fee for the transfer (DM 227/2015), registration and change of ownership: approximately €1,000-€2,500
  • Indicative total budget starting from €65,820: about €68,236-€74,344
  • Estimate starting from the minimum offer: monthly instalment of about €226 with a 70% mortgage (€46,074) over 25 years at 3.3%; you need about €22,162 in savings: the 30% not covered by the mortgage (the deposit paid is part of it and is deducted from the price), the tax and the fees
  • These are estimates based on the general rules, not a quote: the exact figure depends on the notice, your tax situation and the bank.
