If you buy an occupied home at auction, you do not move in straight away: vacating the property is a separate step, which usually goes through the judge and the court-appointed custodian (custode giudiziario). The time depends on the court and on who lives in the property, so the exact timing cannot be known in advance.
What does it mean that a home is occupied?
A property is occupied when someone lives there or keeps their belongings there without you, as the new owner, having decided so. This may be the debtor whose property has been seized (pignorato), a tenant with a rental contract, or a person who has no right at all to be there.
The notice of sale (avviso di vendita) and the appraisal report (perizia) always state who is inside and on what basis. Read the section on occupancy status before making any bid. To understand how to read the document, see come leggere la perizia di un'asta, sezione per sezione.
Who decides whether the property must be vacated?
In the procedure there is the enforcement judge (giudice dell'esecuzione), who directs the sale. The court-appointed custodian (custode giudiziario) is the person appointed by the judge to safeguard the property, organise viewings and, if needed, carry out the vacate order (ordine di liberazione). The sale delegate (delegato alla vendita), usually a notary or a lawyer, manages the auction and prepares the transfer decree (decreto di trasferimento).
The general rule is this: after the transfer decree, the order to release the property is contained in the decree itself and can be enforced by the custodian, without the need for a separate lawsuit. The mechanism is explained in detail in the article on the ordine di liberazione: cos'è e chi lo emette.
How does vacating change depending on who is inside?
The most common situation is that of the debtor who still lives in the home with their family. If they look after the property well and cooperate with viewings, they can stay until the transfer decree. After the decree, however, they must leave. For details see occupato dal debitore: cosa succede dopo l'asta.
A tenant with a rental contract may instead have a right that remains valid even after the sale. The law says the contract must be respected if it has a certain date (data certa) earlier than the seizure (pignoramento), that is, if it is registered before it. The contract cannot be enforced against you if the rent is lower by a third than the fair price or than that of previous leases (art. 2923 c.c.). Read occupato da un inquilino con contratto: cosa cambia.
If nobody has a valid right to stay in the home, vacating is quicker but not automatic. See occupato senza titolo: come si libera.
How long does it take to vacate the home?
There is no number of days that applies to everyone. It depends on how quickly the court acts, on who occupies the property and on how much they cooperate. The longest time arises when the occupant does not leave and enforcement action is required.
To get an idea of the steps and timings, read tempi di liberazione di un immobile all'asta. The picture also changes with the Cartabia reform, in force since 2023: the article ordine di liberazione dopo la riforma Cartabia (art. 560 c.p.c.) covers it. The exact number of days, if the judge sets one, can be found in the order or in the notice of sale.
Who pays the costs of vacating?
The costs of vacating follow the procedure, and the precise position can be found in the notice of sale and in the judge's order. As a general rule, the buyer should expect that there may be costs to bear for carrying out the release. For a deeper look see costi di liberazione: chi paga.
What happens to furniture left in the home?
If the person occupying the property leaves furniture or items after the release order, the procedure sets out how to handle them. Do not throw them away on your own initiative: first ask the custodian how to proceed. See mobili e beni lasciati nella casa dopo l'asta.
What should you check before making a bid?
Before bidding, read carefully three things: who occupies the property, on what basis, and whether there is a contract registered before the seizure. Then check whether the judge has already ordered a vacate order and to whom it has been entrusted.
If the home is occupied by people who have rights, the risk of long timings is real. Do not dramatise it, but factor it into the price you are willing to pay. A useful comparison is in conviene comprare una casa occupata?.
In practice
- Check in the appraisal report and the notice who occupies the property and on what basis.
- Verify whether there is a rental contract and whether it is registered before the seizure.
- Ask the court-appointed custodian how viewings and vacating will be organised.
- Include the time and cost of vacating in your bid calculation, not just the price.
Frequently asked questions
Can I move into the home as soon as I win the auction?
Usually not. As long as the debtor or another occupant has the right to stay, you must wait for the transfer decree and then for any release order. Entering on your own may expose you to legal problems.
Must a person with a rental contract leave?
It depends on the date and registration of the contract, and on the rent. If the contract is enforceable against you, you take over as landlord and cannot immediately remove the tenant. Check the details with the professional assisting you.
Can I ask the judge to vacate the home before the decree?
In some cases the judge may order vacating even earlier, if the property is occupied by third parties without a valid right. The actual timing depends on the court and the case, so ask the custodian.
